Hinweisgebersystem der CONTI COATINGS GmbH & Co. KG

Die Conti Coatings GmbH & Co. KG möchte mit dem Hinweisgebersystem Verstößen keinen Spielraum lassen, denn ungesetzliches und unethisches Verhalten schädigt die Kluthe Group sowie deren Stakeholder. Ihre Meldung ist ein wertvoller Beitrag zur Aufklärung, Bekämpfung von Missständen sowie der Prävention.

Die Conti Coatings GmbH & Co. KG versichert, dass integres Verhalten zu keiner Benachteiligung führt und Vergeltungsmaßnahmen gegen die Hinweisgeber nicht toleriert werden.

Vertrauen und Loyalität sind uns sehr wichtig, deshalb reichen Sie bitte nur stichhaltige Meldungen ein. Um die erfolgreiche Bearbeitung zur Aufklärung der Missstände erheblich zu unterstützen, können Sie uns gerne freiwillig Ihre Kontaktinformationen übermitteln, über die wir Sie bei Rückfragen erreichen können. Eine Angabe der Kontaktinformationen ist nicht verpflichtend, somit bieten wir den hinweisgebenden Personen die Möglichkeit, Hinweise auch anonym abzugeben. Natürlich begrüßen wir auch die Meldung von Verbesserungsvorschlägen bezüglich unserer Tätigkeit. Diese Verbesserungsvorschläge können ebenfalls anonym eingereicht werden.

Über das eingerichtete Hinweisgebersystem können Informationen zu Verstößen unter anderem in folgenden Bereichen mitgeteilt werden:

• Interessenkonflikte
• Datenschutz
• Schutz von Geschäftsgeheimnissen
• IT-Sicherheit
• Im- und Exportkontrolle und Außenwirtschaftsrecht
• Kartell- und/oder Wettbewerbsrecht
• Bekämpfung von Geldwäsche und Terrorismusfinanzierung
• Bestechungen, Betrug, Diebstahl und Unterschlagung
• Manipulation im Rahmen der Rechnungslegung
• Betriebliche Belange wie Umweltschutz, Arbeitssicherheit und Gesundheit
• Menschenrechte (inklusive Kinderarbeit)
• Beeinträchtigung des Hinweisgebersystems, z. B. Vergeltungsmaßnahmen gegen Hinweisgeber, Verletzung der Vertraulichkeit
• Sonstige Delikte

Wichtig: Hinweisgebende Personen sollten die Ihnen übermittelten Zugangsdaten (Link und selbstvergebenes Passwort) gut aufbewahren und sich regelmäßig in das elektronische Postfach einwählen, da dies das Kommunikationsmedium im Hinweis- und Beschwerdeverfahren ist.

Eingehende Hinweise werden von unserer zuständigen beauftragten Stelle geprüft. Die Hinweise werden ernst genommen und im gesetzlich zulässigen Rahmen vertraulich bearbeitet. Alle Untersuchungen werden stets unabhängig, unparteiisch und fair anhand folgender Schritte durchgeführt:

• Eingang Ihres Hinweises
• Versenden einer Eingangsbestätigung an den Hinweisgeber innerhalb von 7 Tagen
• Einleitung einer Sachverhaltsaufklärung (auf Wunsch des Hinweisgebers auch gerne durch persönliche Zusammenkunft)
• Es können Rückfragen während der Bearbeitung des Hinweises auftreten. Wir empfehlen daher mit der bearbeitenden Stelle in Kontakt zu bleiben. Spätestens 3 Monate nach Bestätigung des Eingangs des Hinweises erfolgt eine Rückmeldung an die hinweisgebende Person zum Bearbeitungsstand.
• Es obliegt der Conti Coatings GmbH & Co. KG falls eine Untersuchung zur Sachverhaltsaufklärung eingeleitet wird, diese abzuschließen sowie die Ergebnisse zu bewerten und entsprechende Maßnahmen zu ergreifen. Wenn notwendig, werden wir sofortige Abstellmaßnahmen in die Wege leiten.

Unser Hinweisgebersystem wird durch einen geprüften Drittanbieter zur Verfügung gestellt.

Das Hinweisgebersystem steht den Hinweisgebern jederzeit in mehreren Sprachen zur Verfügung.

Weiterhin besteht die Möglichkeit, externe Meldestellen zu kontaktieren.

Conti Coatings GmbH & Co. KG does not want to leave any room for violations with the whistleblower system, because unlawful and unethical behavior harms the Kluthe Group as well as its stakeholders. Your report is a valuable contribution to clarification, combating wrongdoing and prevention.

Conti Coatings GmbH & Co. KG assures that conduct with integrity will not lead to any disadvantage and that retaliatory measures against whistleblowers will not be tolerated.

Trust and loyalty are very important to us, so please submit only accurate notifications. In order to significantly support successful processing to clarify the grievances, you are welcome to voluntarily provide us with your contact information, which we can use to reach you in the event of queries. It is not obligatory to provide contact information, so we offer whistleblowers the option of submitting reports anonymously. Of course, we also welcome the reporting of suggestions for improvement regarding our activities. These suggestions for improvement can also be submitted anonymously.

Information on violations in the following areas, among others, can be reported via the established whistleblower system:

• Conflicts of interest
• Data privacy and protection
• Protection of trade secrets
• IT security
• Import and export control and foreign trade law
• Antitrust and/or competition law
• Combating money laundering and terrorist financing
• Bribery, fraud, theft and embezzlement
• Manipulation in the context of accounting
• Operational issues such as environmental protection, occupational health and safety
• Human rights (including child labor)
• Interference with the whistleblowing system, e.g. retaliation against whistleblowers, breach of confidentiality
• Other offenses

Important: Whistleblowers should keep the access data they receive (link and self-assigned password) safe and regularly log into the electronic mailbox, as this is the communication medium in the whistleblowing and complaints procedure.

Any information received will be examined by our responsible authorized office. The information is taken seriously and processed confidentially to the extent permitted by law. All investigations are always conducted independently, impartially and fairly using the following steps:

• Receipt of your notification

• Sending an acknowledgement of receipt to the whistleblower within 7 days

• Initiation of a clarification of the facts (at the whistleblower's request, we can also arrange a personal meeting).

• There may be queries during the processing of the notification. We therefore recommend that you remain in contact with the office handling the case. At the latest 3 months after confirmation of receipt of the notification, feedback on the processing status will be sent to the person providing the notification.

• If an investigation is initiated to clarify the facts, it is the responsibility of Conti Coatings GmbH & Co. KG to complete this investigation, evaluate the results and take appropriate action. If necessary, we will initiate immediate remedial measures.

Our whistleblower system is provided by a vetted third-party provider.

The whistleblower system is available to whistleblowers in several languages at all times.

Furthermore, it is possible to contact external reporting bodies.
